Bandit Agreement

This Bandit Agreement (“Agreement”) is a binding contract between The Rubber Bandit (“Company,” “we,” “us”) and you (“Bandit,” “you”). By applying for and accepting Bandit status, you agree to all terms below.

1. Commission Structure & Payment

Tiered model. You earn a commission on every box ordered by customers who sign up through your unique referral link or code. Tiers are based on monthly box count and are retroactive — once you cross a threshold in a calendar month, every box that month earns the higher rate:

  • 1–49 boxes: 5% of product subtotal
  • 50–99 boxes: 10% of product subtotal
  • 100+ boxes: 20% of product subtotal

Product subtotal means the price of boxes and product upgrades only — excluding shipping, taxes, and discounts.

Lifetime referrals. When a customer first orders through your link or code, they are permanently attributed to you. You earn on every box they order — today, next month, next year — for as long as this Agreement is in good standing. This residual income is non-transferable and exclusive to you.

Payout schedule. Payout periods run the 16th of a month to the 15th of the next. Payouts are issued on the 15th once the period is finalized, via your registered method (bank transfer/ACH, PayPal, or check). There is no minimum payout — if you earn $5, we pay $5.

Taxes. Commission income is taxable and you are solely responsible for reporting it. We provide a Form 1099 if you earn $600 or more in a calendar year (US).

2. Attribution Rules

Attribution occurs the first time a customer orders through your referral link or code, and it is permanent. If a customer uses multiple links or codes, the first valid attribution wins — one customer belongs to one Bandit, forever. Customers who order without any referral are “organic” and generate no commission. You cannot be attributed the same customer twice.

3. Refunds, Replacements & Chargebacks

All sales are final upon shipment. The Rubber Bandit does not issue customer refunds on shipped orders. See our Refund Policy for the customer-facing details.

Replacements do NOT reverse your commission. When a customer's order is lost, damaged, or incorrect, we ship a free replacement — we absorb that cost. The original order stays completed and you keep your commission. A replacement never affects your earnings.

The only events that reverse a commission are:

  • Pre-ship cancellation — a customer cancels before the order ships and is refunded.
  • Chargeback — a customer's bank disputes the charge and the dispute is lost. You are not responsible for chargeback fees; you only lose the commission on the disputed order.
  • Fraud reversal — an order is confirmed fraudulent (e.g., stolen card) and reversed.

Chargeback abuse. If more than 5% of your referred orders result in chargebacks, or we detect a coordinated pattern, we may pause your link and investigate (see Section 7). If we detect fraudulent orders, bot signups, or coordinated abuse from your referrals, we will investigate, reverse any fraudulent commissions, notify you in writing, and may suspend or terminate your status.

4. Referral Link & Code Usage

Your referral link and code are for your exclusive use — you may not share, sell, or transfer them. You may promote through your own social accounts, website, DMs, stories, podcasts, video, and any organic, authentic method.

You may NOT promote using:

  • Automated bots or spam tools
  • Paid advertising without prior written approval
  • Misleading or false claims, fake reviews, or astroturfing
  • Keyword stuffing or cloaking
  • Purchased traffic or followers
  • Any method that violates a platform's terms of service

When promoting, represent the brand honestly, use only approved materials, and never misrepresent the product, company, or commission terms.

5. Your Responsibilities & Conduct

You represent that you have a genuine audience, that your promotion is authentic, and that you will not use bots, fake accounts, purchased traffic, click fraud, or engineered chargebacks. You agree to comply with the terms of every platform you promote on; if a platform suspends your account, your Bandit status may be paused pending review. Commission rates and payout amounts are confidential — you may say you earn commission, but not specific figures without written approval.

6. Intellectual Property

All trademarks, logos, copy, and product imagery belong to The Rubber Bandit and may be used only to promote your referral link under this Agreement. You keep ownership of your original content; by promoting us, you grant us permission to repost and republish that content with credit across our channels.

7. Termination & Suspension

By you: email bandits@therubberbandit.com with 7 days' notice. Your link deactivates and you stop earning new commissions, but any earned-but-unpaid commission is paid on the next scheduled payout. Customers already attributed to you remain yours and you continue earning on their future orders — your referrals are yours even if you step back.

By us: we may suspend or terminate immediately for any violation of this Agreement — fraud, click fraud, refund/chargeback abuse, misrepresentation, prohibited promotion, platform bans, or activity flagged as suspicious. On termination your link deactivates, you cannot earn on new orders, and earned-but-unpaid commission is paid on the next payout unless fraud is determined (in which case it may be forfeited).

Appeals: if suspended, you may appeal within 14 days by emailing bandits@therubberbandit.com with your handle, an explanation, and any supporting evidence. We respond within 7 business days.

8. Program Changes

We may modify this Agreement, commission rates, or program terms at any time, with 30 days' written notice for changes to future earnings. Changes are not retroactive — commission already earned stays at the rate in effect when the order was placed.

9. Liability & Disclaimers

You are an independent contractor, not an employee, agent, or representative of The Rubber Bandit. We make no guarantee of earnings. You are not responsible for product quality or customer claims — the Company is solely liable for product matters. We are not responsible for third-party platform issues or account suspensions.

10. Payment & Accuracy

Keep your payout details current in your dashboard before the 15th of each month. If payment information is incomplete or incorrect, your payout may be delayed or fail; we will notify you and retry on the next cycle. You can change your payout method anytime — changes take effect on the next payout date.

11. Data & Privacy

We collect your name, email, phone, social handles, follower counts, payout details, and commission/referral data to calculate payouts, detect fraud, improve the program, and contact you about your account. We do not sell your data. Your payout information and individual earnings are kept confidential.

12. Dispute Resolution

If you dispute a payout or attribution, email bandits@therubberbandit.com with a description, relevant order numbers or dates, and any documentation. We respond within 7 business days and both parties agree to resolve in good faith. Our final decision is binding as a business dispute process; if you disagree, you may pursue legal action in a court of competent jurisdiction.

13. Entire Agreement

This Agreement, together with our Privacy Policy and Terms of Service, is the entire agreement between you and us. No side agreements or verbal promises override this document.

14. Governing Law

This Agreement is governed by the laws of the State of Texas, without regard to conflicts of law.
